DAVID YEK ARCHITECT |
We are Architects by profession, Designers by career. We aim at instigating design at every levels from the smallest of the furniture to the largest of urban design. In between we dwell in the realm of design management, ultimately leading to the role of managing problems, from inception to execution.

DYA ARCHITECTURAL APPROACH |
DYA formative years had been deeply influenced by the notion of OBSOLESCENCE, whereby things and events that had occurred around us had been seamlessly transformed and obsolete the very moment it has been created. For example, KODAK as a company has gone bankrupt the moment digital photography enters main streams, UBER as a service provider is running a largest Taxi company without owning a single vehicle. Yet, the paradox of the building industry is - building is still being built with brick and mortar... Therefore, our approach is to investigate architecture from the first principle. This approach, we called THE MODEL OF PRODUCTION.

Mr Yek had a very positive outlook throughout and his manner was engaging and helpful. He understood the mediation process, the evaluative aspect to mediation and the strength of reality checking. We would recommend that he takes cognisance of the recommendations and with that in mind we are happy to recommend Mr Yek for accreditation as an RICS evaluative mediator. - RICS Assessors (2020)

A Courtesy Call to the Judiciary ... 120320
A visit to the judiciary, Construction Court KL under the courtesy visit of PAM_ADR committee meeting YA Dato Lim Chong Fong and YA Dato Hajah Aliza binti Sulaiman, exchanging views on the current CIPAA reform and laws affecting the construction industries. Apparently Adjudication is here to stay as presented by the court, the enforcement of decisions are pretty high, above 80% threshold. Not too bad at all as this figure will encourage more of Adjudication and lessen the courts' burden to deal with cases and backlog of cases. Arbitration on the other hand, has taken even more time compared to litigation. Also discussed were the potentials of mediation and expert determination. We are happy that the courts will be supportive of PAM-ADR undertakings...
ADR SERVICES PROVIDED
Arbitration, a form of alternative dispute resolution (ADR), is a way to resolve disputes outside the courts. The dispute will be decided by one or more persons, which renders the "award". An arbitration award is legally binding on both sides and enforceable in the courts. - Wikipedia
|
Adjudication is a dispute resolution process preliminary resolved by an independent impartial third party, the adjudicator, who decides the dispute within a relatively short period of time. It is usually an expert in technical matters, who can comes to an interim binding decision. - HKICAdj
|
Mediation is essentially a negotiation facilitated by a neutral third party. Unlike arbitration, which is a process of ADR somewhat similar to trial, mediation doesn't involve decision making by the neutral third party. ADR procedures can be initiated by the parties or may be compelled by the courts, - FindLaw
|
Expert Determination is a process of conflict resolution whereby at any time, the party can call upon an expert to decide on a matter crucial for them to carry on without interruption to the project usually related to technical matters such as defects, QAQC, that require immediate resolution.

an INTERVIEW with Dr NaseemOn POST-GRAD Learning on CONSTRUCTION LAWEarlier this week, I had the pleasure of being interviewed by Dr Naseem Ameer Ali Associate Professor and Postgraduate Director, Massey University New Zealand for the Forum of the Society of Construction Law #SCL NZ. The gist of the interview, focused on my reflection of being the student of law in Robert Gordon University. Interestingly, being an unofficial 'ambassador' for Robert Gordon University - International, I did shared a short remark that being an #architect there is more than #design that I have to deal with and dealing with the intricacies of human relationship and the law in the construction field, eventually lead to many other opportunities in ADR, claim consultancy and others. Do enjoy this short 6-minute interview and technical professionals liked architect, #engineer and #qs are encouraged to embark on the 'life long journey' of learning.

PAM cpd UNLIMITED 2.0Introduction to EVALUATIVE MEDIATION for Construction DisputesThe Covid-Act placed ‘Mediation’ as the preferred ADR-method. PAM-Advisory has promoted Architects as ‘Negotiator’. Question is what is Negotiation? Simply a ‘Table-Talk’? Failing which, parties use whatever means to arm-twist one-another? Are Architects competent in negotiation? Are Architects stepping into legal-landmines while discharging as negotiators? This is to highlight the unfamiliar-ground of venturing into ADR-abyss, with guided Mediation-framework where Negotiation is integral in Civil-Commercial Mediation-Procedure. NOW, is the time Architects must undertake responsibility beyond just ‘contract-administration’, to be competent-Mediators.

|
泉緣堂The QUANYUAN Group 泉緣堂 was named from these words, the spring water collates at its affinity 泉水之緣, derived from a divination of #1-4, many would have considered, 1☵ over 4☴, but we reckoned it to be ☷1 over ☱4 (Hexagram 19 臨 nearing) instead, following the huge SanYuan 大三元 principle. To truly understand the meaning of 臨 ‘nearing’, the story would have to be told from its inception of the three original founders 長老 that came together under the decree of the guardian deity of Chinese Metaphysics 玄門 namely the Mysterious Maiden of the Nine Heaven 九天玄女.
|
三元長老The formalisation of the initial three founders 長老, hereinafter called SanYuan 三元 were initiated in the Heavenly Dragon Palace 龍天宮 the only temple of the Mysterious Maiden of the Nine Heaven 九天玄女 in Kuala Lumpur. This SanYuan 三元 defined the roles and the obligations of these founders namely, the Heaven Gua 乾卦 in-charged of geomancy 地理, the Human Gua 人卦 in-charged of life sciences 命卦 and the Earth Gua 坤卦 in-charged as the oracle 童乩 and healing 治療師.
|
廣結善緣On the joyous occasion of Human Gua 人卦 completing his entire JiaZi 甲子, the second decree came in the form of a stanza, the ‘Vastness Comes Together in Dispersing Noble Affinity’, 廣結善緣 by the deity of the Supreme Old Master 太上老君 to the Heaven Gua 乾卦. From these stanza, the lineage of each master 師 is established, namely GuangYuan Shi(Qian) 廣緣室(乾), JieYuan Shi(Ren) 結緣室(人) and SanYuan Shi(Di) 善緣室(地). Subsequent students that are learning from these masters are to follow these streams.

ENCOUNTERING
|
David has a lasting encounter with Chinese Metaphysics Practitioner in his early years of practice, namely collaborating with the established Grandmaster Yap ChengHai. As he succumbs to various inconsistent requirements of the FengShui practices, instead of following blindly, he opted to pick up the skill as well by initially studying formally from the Academy of Chinese Metaphysics, led by Joey Yap to a level of achievement and awarded a Diploma to that effect. His thirst for the esoteric knowledge has brought him beyond such formal accolades that he seeks tutelage from other masters beyond Singapore, HongKong and Taiwan. His interest has finally brought him to another level that enable him to practice professionally, thus he is one of the founding partners of FengShui QuanYuan, an establishment of traditional FengShui practitioners which emphasized on results consistency and no nonsense policy. He classifies his approach as ZhongHe or the combinations of the two mainstream schools of thoughts of SanHe and SanYuan. However, his main pet method is still SanHe.

AN EXPERIMENTATION ON THE EMPLOYMENT OF DIALOUGE-DO-DOCUMENT (3Ds) MODUS-OPERANDI AS AN ARCHITECTURAL DESIGN PEDAGOGY WITH EMPHASIS ON MODEL BASED PARADIGM (MBP) AS A BASIS OF ARCHITECTURAL PRODUCTION
Our principal David Yek Tak Wai had delivered a paper on design pedagogy in architectural education in this International Conference late last year organized by PAM. It is now published as a monograph, by Prof Robert Powell, to be launched 2nd Oct 2019 at One Utama... we were glad to be associated with this publication as a gesture to immortalized David's students work from the batch of dekon:4 UCSI in an academic writing for posterity as he has promised to his students... now, fulfilling it! Come and celebrate with us, tomorrow!

DISCOURSE IN SEM 03
Design discourse in Sem-3 began with a design vehicle of an installation narrating the writings of Sybil. Little was known that the actors attempted to interpret their ideations as arrays of representation such as, blue represents unity, white purity, red bravery, yellow royalty and so forth, very similar to how our secondary school design pedagogy of the meanings of our national flag. Such pedagogy was rather artificial and lacked of a deeper understanding of the order of things.
|
Deploying the deconstruction design pedagogy, the notion of Architectural Semiotics were applied by first deconstructing the commonly known notion then reconstructing into an uncommonly known notion. The actors were guided into deconstructing the writings of Sybil into reconstructing an entire new notion of narrative into their installations, we called the act ...

DISCOURSE IN SEM 06 |
3D modus operandi:-
Dialogue - Intention Do - Action Document – Production The whole process will therefore repeat itself ad-infinitum in the generation of ideas, events and hopefully, product of architectural significant. The essences of dialogue are the crystallization of ideas and architectural discourse at a theoretical level in amplifying the objectives of a given design vehicle of which studio participants are required to engage in debate, forum, talk-shop, soap-box and other experimental verbal discourse such as songs, poems and others at a subliminal level called INTENTION. Subsequently such intentions are translated into doing such an experiment like crafting, building, drawing, sketching, painting, sculpturing, photo-managing, computing and others as transformation of subliminal forms into something tangible with or without the impact on the school, studio or the society at large almost known as ACTION. The result of these collective works are the document as a substance for further discourses and again at a subliminal level to provide food of creativity for the future works ad-infinitum named PRODUCTION of portfolios. |

DIScourse IN UTAR - 2019DESIGN CHALLENGE : Positively responsive to the Historical and Cultural background of the local Community in Kota Bharu.
Synopsis: Kota Bharu undergoes a relatively slow but steady development comparing to other big cities in Malaysia like Penang, Kuala Lumpur & Johor. Along with this development, it has brought a boon to a certain areas but at the same time also a bane to other areas; eg. old commercial zone. |
DIScourse IN UTAR - 2019 (2)On the other hand, with its urbanization in progress, the city is expanding outward and causing stress to the old commercial area. Some of the aging shop houses owners chose to stop running business due to emergence of the much bigger players and new concept of hypermarket offering a "one stop" convenience to the younger generation. Hypermarket such as TESCO, MYDIN, PARKSON and many others are taking up the commercial lead in Kota Bharu.

Throughout the past decades of development, Alor Setar experiences a shift in its socio economy, urban development under its city planning initiative.

DIScourse IN UTM - 2016As in many parts of the world, currently in Malaysia, there is a rising number of Elderly (Department of Statistics Malaysia). They are getting well financed, educated and independent (Ong, 2007). Therefore, there is an increasing demand for elderly care (Waters 2007). However, currently the housing development in Malaysia for elderly is ill suited (Chee and Barraclough, 2007). The elderly dilemma can be presented through various aspects (Dalila and Khan, 2013):

One observation on the products are the obsession of creating a grand scheme without having the time and guts to challenge the Brief, the Architecture and its Discourse. The actors tend to play safe in generating mundane modern architecture with half cooked programming.
|
The revisit shows a significant improvement in the product but lack the guts to go above the Brief. The Unit known as REFORM seems to be toned down to CONFORM. The presentations are very down to earth without any attempt to break through - the sky still look Blue and the Grass still look Green. The conceptualization through the abstract does not appear to be presence. Even the level of discourse are in the realm of the mundane. It truly lacks the aura of philosophical and sophisticated touch.

MY TRAVELOUGE |
It took me a while to understand as so much had been spent to travel and yet we are overly busy to snap shot our existence in every backdrops of scenery captured in the travel photos. Do we really need to proof we had indeed arrived at the destination?
Do we need to proof our existence? If not, why do we dwell in the dilemma of proof, given the beauty of a place, enjoying its spirit in form, smell, sound and essence of senses. Some times, simply difficult to even put into writings, let alone words of wisdom. Indeed life as we traveled, is the scenery of existence that most had taken for granted. Perhaps we need to snap shot such proof of life in the photo of our existence consciously reminding myself as I had lived to see the world and I had lived long to tell a tale, but yet not long enough to behold its changes. Yes, from the generation of now to the others. Perhaps the sky no longer blue, sea no longer blue and the grass no longer green. Until such a time, I knew for sure, I had lived to proof my existence. That the photo is no longer my tool of remembrance. Perhaps, memory itself is the very proof of the existence I had been bestowed upon. Yet, vividly be my companion of sorrow and happiness. Perhaps all I need is drinking tea, living life... |
