MEDIATION SKILL SETS LEV 01 & 02

Mediation is a soft skill set that is premised against the use of psychological and persuasive approach to resolve dispute. The core competency of a mediator is judged based on these following criteria that have been developed as 'facilitative mediation':

​Developing as a mediator: 

  1. local mediation marketplace,
  2. local jurisdiction issues,
  3. how to build a mediation profile,
  4. ways to develop as a mediator

​Technical skills: 

  1. managing expectations,
  2. forming an agenda,
  3. identifying needs,
  4. identifying common ground,
  5. breaking impasses,
  6. doubt creation,
  7. reality testing,
  8. dealing with walkout,
  1. dealing with apparent power imbalances,
  2. option generation and
  3. creative problem solving,
  4. communicating offers,
  5. managing lawyers and other advisors,
  6. drafting an agreement

Process knowledge: 

  1. understanding the benefits and risks of each stage of the mediation process,
  2. how to set up a mediation,
  3. preparatory steps for the mediator and the parties in dispute, designing an effective process,
  4. managing the process,
  5. ethical issues,
  6. confidentiality,
  7. liability of the mediator,
  8. mediator appointment agreement,
  9. confidentiality agreements
